This privacy statement applies to all services covered by Louwman Exclusive Cars B.V., hereinafter LEC, part of Louwman Group.

1. The Responsible Party

LEC is the controller of your personal data. LEC is committed to providing high quality services. Reliability is an important factor in this. We regard respect for our customers’ privacy and careful handling of their personal data as an important part of the reliability of services. This privacy statement provides general information on how we handle your personal data.

2. Our purpose: protection of personal data

LEC respects the privacy of its customers. In carrying out its activities, the protection of personal data is therefore very important to LEC. Personal data is handled and secured with the utmost care. LEC makes every effort to secure the collection, transmission and storage of personal data, in accordance with the nature of such information. LEC has implemented technological solutions with the aim of protecting your personal data from unauthorised access and use. If necessary, we will update these measures when new, generally accepted security standards or technology becomes available.

3. What is personal data?

Once data can identify you as a person, these data are called personal data. Examples of personal data are your name, address, date of birth and bank account number. Your IP address or user name may also qualify as personal data. In order to use our services, we need your personal data.

4. What personal data do we process from you?

We would like to serve you well as you have come to expect from us. To ensure that you can use our services, we need your personal data. Depending on the service or product you purchase from us, we may require the following personal data from you, among others:

We will only use the personal data you provide for the purposes we have previously communicated to you. Furthermore, you can find more information about some of these purposes in this privacy statement.
In addition, LEC may process the following data in the context of the performance of an agreement with you:

• registration number, serial number and model of a vehicle;
• technical data about a vehicle;
• maintenance history of a vehicle
• ownership history of a vehicle (registration data);
• other data relevant to the relevant agreement;
• technical data about a vehicle, including connected car.

5. What do we use your personal data for?

No sale of personal data to third parties
We would like to remain honest and transparent about the use of your personal data. Your personal data that you have provided to us in order to use LEC’s services will only be used for the purposes listed below. We will not sell your personal data to third parties, but data may be exchanged within the Louwman Group, the importer or manufacturer of your product within the stated purposes.

Purpose and use of personal data

Processing of your personal data always takes place on a legal basis, namely:

• Execution of an agreement with you;
• Legitimate interest of LEC or a third party, e.g. marketing, advertising, security, (crime) prevention, IT management, research and analysis of own products or services, corporate governance, legal affairs, internal management;
• Consent from you;
• A legal obligation; or
• Performance of a task of public interest.

We would like to further explain the above below.
As a car dealership, LEC provides products and services in the field of automobility in a broad sense (service, maintenance, rental, leasing, financing, sales, mediation and a multitude of mobility services). We collect and use your personal data that you have entrusted to us to provide you with services or information. When you conclude a product, purchase a service or when you have contact with LEC, LEC records personal data. LEC processes these personal data for entering into and performing our services as well as for the purposes listed below.

Preventing fraud and abuse. Unfortunately, companies, including LEC, are sometimes faced with falsely submitted claims or declarations. This does not benefit LEC or its customers. Personal data can also be used to prevent this kind of abuse.

Sharing with third parties. For a number of services we use external parties who support us in providing the product or service requested by you, and for this reason your personal data are shared with this third party. Your personal details may be passed on to other companies within Louwman Group or third parties who (help) deliver the services and/or products offered, including car importers or car manufacturers Lexus Nederland, Bentley Motors Limited, Automobili Lamborghini S.p.A., Maserati SPA, McLaren Automotive Limited, Morgan Motor Company Sales Ltd, TVR Parts LTD, TVR Manufacturing Limited. Naturally, we make proper agreements with these external parties on the careful handling of your personal data.

If you have given your explicit consent, the above-mentioned car importers, car manufacturers and other companies within Louwman Group (see www.louwmangroup.nl), including Alcredis Finance, Suzuki Nederland, Louwman Dealer Companies, Van Dorst Automotive, Blauwendaal, Rüttchen Automotive, Auto.nl and the Louwman Museum may offer information about their services and/or products. If you no longer appreciate this, you can withdraw your consent at any time.

Improvement of services. We use your personal data collected through our services to provide you with a good service and to develop new products and services.

Improvement of website and applications. To constantly improve our website, LEC records (personal) data on the use of our website by means of cookies, web beacons and other similar information-storage technologies. Our aim is to personalise advertising messages and provide a better, faster and safer customer experience.

We may share this data, which in some circumstances may be personal data, with third-party analytics providers on our behalf. For information on cookies, or if you do not want cookies, please refer to our cookie statement (see www.louwmanexclusive.nl/cookiebeleid).

Relationship management and marketing. We process personal data for our relationship management and to carry out targeted marketing activities. On the basis of data from internal and external sources and your visit to our web pages, we can make appropriate and targeted commercial offers to you, for example by mail, telephone or internet.

Legal obligations. It is possible that we may be forced to disclose personal data to authorities or other third parties. For example, if this is necessary in connection with a legal obligation or for the performance of a task under public law.

Retention period. We do not keep your personal data for longer than necessary, unless there is a legal obligation on us to keep personal data for longer. We need your personal data to serve you well. This also primarily determines the period we keep your personal data. Our basic principle is that we keep personal data only as long as necessary to provide you with the service or as long as there is a legitimate interest for this. After this, we will delete, screen or anonymise your personal data.

To comply with contractual obligations, data collected from you may be retained for as long as the contract is in force and – depending on the nature and scope of the contract – beyond that in order to comply with legal retention requirements and to answer any queries or resolve any complaints after termination of the contract.

Data which, in our opinion, are necessary to assess and prevent claims against us or to institute criminal proceedings or to prevent claims against you, us or third parties, may be retained by us for as long as the relevant proceedings could be instituted.

6. Security and processors

We secure your personal data stored with us. We naturally make every effort to secure your personal data to the best of our ability against unauthorised access, loss or theft. To this end, we have established internal policies to ensure that our products and services are designed in such a way that an appropriate level of security applies as standard. LEC employees only have access to your personal data if this is necessary for the performance of their duties.

We make arrangements for the security of your personal data that we have processed with an external party. If we engage an external party to process personal data for our services, we ensure that this party also meets our security requirements. We do this by concluding a so-called ‘processing agreement’ in which we lay down, among other things, agreements on the security measures to be taken and on the use of the personal data.

7. Your rights and contact

You have the right to inspect the personal data we process about you. In addition, in some cases you have the right to have the processing of personal data corrected, blocked or deleted. Furthermore, you have the right to withdraw your consent, insofar as our processing of your personal data is based on it, the right to lodge a complaint with the Personal Data Authority, the right to restrict the processing concerning you and the right to data portability. The latter means that you can transfer your personal data (or have it transferred). Should you wish to exercise your rights, please contact LEC. If you have any questions about how LEC handles your personal data, or wish to exercise any of your privacy rights, please contact LEC via https://privacy.louwmangroup.nl/louwmanexclusive, stating ‘Privacy Louwman Exclusive Cars’. If LEC cannot or cannot fully determine to which personal data your request for inspection, modification or deletion relates, LEC may ask you to (further) specify your request. LEC will suspend the execution of your request until you have provided the (further) specification.

We last amended our privacy statement on 24 May 2018. LEC reserves the right to amend its privacy policy. LEC therefore advises you to check this page regularly to see if any changes have been made. We will inform you of any material changes to our privacy policy.
